LITIGATION (Claims & Court Disputes)

As experienced Litigation Solicitors in Hampshire we aim to resolve litigation issues as speedily and in the most cost effective way possible and serve clients mainly in the HAMPSHIRE and SURREY areas but also beyond.

We act for Claimants and Defendants in the High Court and County Court and certain Tribunals (Employment and Land).

We undertake the following Litigation work:-

(1)  COMMERCIAL LITIGATION

  • Building disputes

  • Various contract disputes (including Sales of Goods and Services)

  • Debt Recovery

  • Insolvency – winding-up and director’s disqualification

  • Partnership disputes and dissolutions

  • Negligence and nuisance claims

  • Landlord and Tenant (including Personal Guarantees and Indemnities).

(2)  CIVIL LITIGATION

  • Boundary and rights of way disputes

  • Employment Law

  • Building and planning issues

  • Matrimonial and co-habitee disputes

  • Landlord and Tenant (Residential)

  • Debt and Bankruptcy

  • Personal Injury and Road Accident Claims (Multi-Track)

  • Clinical Negligence (e.g. MRSA)

  • Professional Negligence

  • Contested Wills and Probate, Inheritance Act claims and Trust Litigation - here we can act for both clients who are Claimants or on behalf of the Deceased’s Estate.

Please see also our Web Pages on “Family Law” and “Wills & Trusts”.

ADR (ALTERNATIVE DISPUTE RESOLUTION)

Due to the increasing emphasis by Courts (and Tribunals) for proceedings to be the last resort and owing to the potentially serious cost consequences to clients in not first attempting dispute resolution (ADR) it is most important that parties seek expert advice at an early stage of any dispute.  For this reason we encourage clients to seek resolution through independent mediation or other forms of settlement.

In difficult cases we liaise and instruct specialist practitioners at the Bar in London and outside.  Our selection is based on a combination of expertise and cost effectiveness.
