In undertaking a professional negligence claim an
aggrieved client needs to be able to prove that their
previous adviser
fell below the recognised standard within the relevant
profession, and must show that there was: -
(1)
Duty of care; and
(2)
A breach of that
duty of care; and
(3)
Damage or loss was suffered by the aggrieved client as a result
of the act or omission.
Due to the not
infrequent difficulty of being able to prove legal
negligence and because of the need to be aware of the
limitation period for purposes of making a claim, expert
advice should be obtained at the earliest opportunity.
