  • Inheritance (Provision for Family & Dependants) Act 1975 Claims.
     


In this area of the law we have extensive experience in assisting clients:-

(1) Who wish to make a claim against the Estate of a Deceased spouse, former spouse or unmarried partner; and who seek reasonable financial provision against the Deceased’s Estate where either:
     (a) The Deceased made no financial provision for the surviving partner in any Will;
     (b) The Deceased made inadequate financial provision for the surviving partner in any Will;
     (c) The Deceased made no Will and the surviving partner is a qualifying person under the 1975 Act
          and has a need for financial provision.


(2) Who are Executors and/or Residuary Beneficiaries of the Deceased’s Estate and who wish to defend a claim made against that Estate by (usually) a surviving partner of the Deceased.
 

  • Claims against previous negligent legal advisers (eg. delayed and defective Wills or when the testator lacked mental capacity).

  • Claims where Wills are made or changed due to another persons Undue Influence.

  • Proprietary Estoppel claims based on lifetime promises made to living survivors/dependants.
